The Abu Dhabi Supreme Court has directed a transport and contracting company to pay an Indian surveyor Dh1 million in compensation after he lost one of his eyes in an accident at his work site.

The 30-year-old victim, R.P.K. from Kerala, India, had met with the accident in Abu Dhabi in 2009. In the accident which took place on the Shahama-Sadiat Road, he lost his left eye, fractured some bones on his face and also lost his teeth. R.P.K. was rushed to Al Rahba Hospital, from where he was referred to Al Mafraq Hospital. After 20 days of hospitalisation, he was discharged, after which he returned to India for further treatment.

Before leaving for India, his relatives approached Advocate Shamsudeen Karunagappally of Al Kabaan Advocates who was given the power of attorney to file a civil case. The advocate filed the civil case and asked for Dh3 million as compensation.

The Court of First Instance directed R.P.K.’s company to pay Dh1 million. The company appealed against the judgment, but the Court of Appeal upheld the judgment. The company then moved to the Abu Dhabi Supreme Court, which upheld the judgment as well.

The lawyer filed for execution and has now received a cheque of Dh1 million, which he will transfer to R.P.K.’s bank account in India.
